Ebay matter, problem with overpriced shipping and damage from the same seller!

Well, I won this auction for my Lucic PC and paid $13.99 for registered mail and received the card today.

1st problem - Item was sent with a DC# and insurance for a total of $4.61 when I paid $13.99.

2nd problem - The bottom right hand corner below Thomas is ripped or lifting off. I had no idea from the scan but now that I have the card in hand I can see clear as day from his listing that is was damaged when in his possession.

What the heck can I do in a situation like this? This is a HUGE PC card that could take another year to come up again and now I have a badly damaged card on my hands and overpaid on shipping!:|

I message the seller so hopefully he responds but I would like to hear what you would do if you spent $200 in a rare PC card and had this happen?

If you ask me, that corner should have been very clearly explained in the photo, no question.

Item not as described, in my opinion. Also same as Paul's post on the shipping charge you paid vs. the service you got (see pike0208's post down a bit).

As for "will you see the card again?"...that's the personal dilemma you're in - if the seller offers you half price on it would you keep it then until one pops up? Only you can answer that one :)

Regardless of whether it was in the photo, it should have been noted in the description, and if it wasnt, Id demand a full refund, he may argue it was in the picture, but its not always easy to see especially if your not looking at a larger view than the thumbnail gives you, as for the shipping, Id bring that up also, he will probably try to give you a bs excuse as to why he charged so much, but that 9 dollar difference is a question mark

I guess I would not have bet as much as I did if I knew it was damaged. If he were to offer me some off I would most likely keep it but he will most likely ask for me to send it back and that's where my problem lies.

This stinks :(
 
Well let us know what he says, both on the shipping, AND the damage.

Damage has to be spelled out in the description in my opinion. I've had the odd card that has a bit of corner damage here or there, but it's always the FIRST thing in the description with ***'s surrounding it, in big bold red letters...and if someone buys it, before they pay, I ask them if they saw the damage note...if not, they can cancel no harm no foul...if they did, and confirm it's OK, then I'm covered :p

I would agree with Kev "Item not as described".

I understand that you would still love to have it for your PC until a good copy comes up, but at a lower $$. Maybe the seller would be willing to discount you. What would he want with a damaged card?? If he had noted the damage in his listings, he would not have gotten this price & I'd be willing to bet that he knows that as well. So maybe he's willing to let it go at a discount.. Worth a shot.

The main thing is that you get what makes you happy. Thats all that really matters.

Bottom right corner dammage on the back Thomas side is clearly visible on the scan, you check both picture in the enlarge and its the first thing that jumps in my face, that corner is messed up.

#1 Its was shipped from Canada with Canada post registered mail for 4.61$ ? It costs me 16 or 18$ to ship registered mail to the U.S, i have to find out how he only pays 4.61 for it.

Im always stunned that people shell out big money on card and dont ask about condition, a banged up corner probally equal nrmnt.

Normally i would say take a lesson out of it, but just saw the seller name...

Here some info on him, do what you want with it.

I met up this guy in a Montreal east depanneur to buy a patch card, i asked him if he add others patch from that set, he reply`s to me that he dosent know squat about cards :confused: , he`s `renting` is name to someone. He just list up cards , and the one with best offer mode he accepts what the other party told him to take for it.
 
I think it is obvious; card not as described!!
It says right in his auction "all cards mint or nrmt". That should say it all. File a complaint if you don't get satisfaction from the seller.
 
It was shipped from US with a DC# and insurance so he must be close to the border.

If it was shipped from Canada registred you would have waited minimum another week for it, id say you got your money worth on shipping out of this.

If i listed a card with a banged up corner i would say so in the listing tho, i been receiving lowball offers on the Sid draft board from my friend since im beeing honest in the description, and people probally shelled out more on a more dammaged one since it wasent describe in the auction.
 
Messed up corner is visible from the picture BUT there MUST MUST MUST be something written in the description.

Regardless of where he ships from the extra $9 cannot be justified unless the card was sent in a new magnetic case with a $5 bill wrapped around it.

What a deadbeat seller. I will fight tooth and nail with him to let ebay know this should not be allowed. I am pissed about the shipping but the damage being known is unacceptable! He doesn't even bother to describe the damage and thinks listing his auctions with nrmint-mint should cover it?!?! Give me a break!
 
I think you now have a case, Nathan.

Claim Item not as described - explain there was no description of the OBVIOUS damage in the auction, and the picture is not enough - yeah you could have caught it there, but scroll up - conscience should tell a seller (if they have one) to be very up front about damage.

Claim is already escalated because the seller wanted me to return it for a full refund. That is not happening here because this card is too rare and it is not my fault he was neglectful in not stating the damage.
 
I personally don't have an issue with the shipping. I've done the drive from Montreal to NY/VT and it is about 2-3 hours when everything is said and done. That's a lot of time, gas, and a decent savings for you seeing as you probably avoided tax on $180 item. If anything, he saved you money.

The damage however, even though the pic shows the bad corner, the description does say otherwise.
 
US residents don't get charged tax so are you saying he saved even more by doing this while on a business trip? I didn't ask for him to drive the distance to the US and paid what he asked so why did he have to make it seem like he was saving me money and time? Registered or xpresspost from Canada gets to me just as quickly and I did pay for that.
 
So, paying an extra $9 for shipping if he lives 2 minutes from the boarder is OK with you??

Personally, if i paid for a high end card, paid 14$ for registered and tracking, and received the card within a week :giggity::dance:, i couldnt care less if the seller made 9$ on it because normally that same 14$ would have got me the card within 2-3 weeks minimum.I get the card faster, seller makes a little more money, where both winners.

So if he gives you a 80$ refund you will be happy about that transaction ? Personally, i dont do partial refund and would have asked you to ship the card back if you wanted a dime back.You dont like it but you will if you get some money back ?

Seller was at fault not describing correctly the item , but you should do your homework as a buyer.If you add stare 5 seconds at the picture you would have seen the dammage.Dont expect every card from UD to be a gem, especially thick cards ala SPGU.A guy with 2400 feedback on ebay and 1000 more on hobby sites should know better then just read a description.
 
I don't think staring at a small thumbnail would have helped me spot this flaw. You guys all see it now that I pointed it out but I checked both pictures before bidding and nothing popped out at me.

If you were waiting for some rare Neal to come in and found it was damaged and you were not told about it what would you want? You really want to send it back when you know damn well it could be a year or more before you see another one or would you ask for a partial refund because the seller didn't do his job pointing out a known flaw?
 
So are you bent that he wants the card back, or that he won't offer you a partial refund?

There's a former HI member who ALWAYS said that every card he got was damaged in order to get a better deal once he had the card in hand. Not saying that's the case here, but the problem with partial refunds is that it opens the door for lots of slimebags to just march on through.

Just get your money back and be done with it.
