Ebay matter, problem with overpriced shipping and damage from the same seller!

I am bent that he sent me a damaged card knowingly. In his message he sent me he stated he put cards are nrmint to mint and didn't even try to explain what could have happened or show remorse for selling it to me damaged. I have a Lucic SPA FW Auto on ebay right now with a small chip on the top black area and highlighted it in red so people know that there is nothing to hide. What's wrong with asking someone to do the same?

Now I have to spend $15 for shipping to send a card back with tracking that isn't my fault. The system isn't perfect but if the other bidder's and I read that this card was damaged I assure you I would not have bid $200+ for my high bid.
 
I dont do partial refund as a seller so i dont ask for them as a buyer.If i aint happy about a transaction a little refund wont make it bitter sweet.

Would your max bet been the same if the damage was pointed out ? Would you still have won the card no matther what ?

Anyways i dont want to argue about others transactions, i have enough trouble with mine, hopefully it turns well for you.

"Please see card and judge the condition for yourself" or some version of this appears in more auctions than not.

If it's visible in the scan (which it is), you should adjust accordingly. Otherwise, blame the guy in the mirror for bidding an inappropriate amount.

OK, so you're out $15 rather than the $200 with a card you're not happy with. I'd say lesson learned, at a 92.5% discount.
 
Claim is already escalated because the seller wanted me to return it for a full refund. That is not happening here because this card is too rare and it is not my fault he was neglectful in not stating the damage.

What more do you want? He is willing to give you a refund. I NEVER give partial refunds. If a buyer isn't happy, he needs to send the card back to me and he gets a full refund.

You have 2 choices here Nathan. Keep the card or send it back and get your refund. Trying to get money AND the card isn't going to happen nor should you expect it to

Would you have bid on the card knowing it was damaged beforehand?

I would have thrown a much lower bid out there if he described the damage. Doesn't matter now people are entitled to their opinions but I see these thread all the time from half the people that are telling me to suck it up so I think this thread has run it's course.
